Substantive topics will include: zoning for rental tenure, affordable housing and special needs housing; people zoning; inclusionary zoning; prohibition of land uses; lawful non-conforming uses (what does “lawfully used” actually mean?); dealing with the Province (issues with overlapping jurisdiction); CACs, PDAs and density bonuses. Themes to be discussed include judicial deference to local elected officials (the test of reasonableness); procedural fairness in the digital age; zoning bylaw interpretation approaches.
